That bolded part; That's fine, but it's up to the owner of the vehicle to ensure they don't tow beyond it's capacity. Towall would have nothing to do with one of their clients towing more than their truck can handle. There are plenty of legitimate products that anyone can buy which can be used unsafely or illegally if the purchaser decides to be ignorant.
