So I was driving in the middle lane of a 3 lane road in Alexandria and this guy in a Mazda Tribute merges into the #1 lane from an on ramp. No big deal. Then he clicks on the old blinker again and starts to come over. Problem being, I am still in it. Got a taxi to my left, a car behind and an coming in from the right. I lay on the horn and he sees me in the mirror and tries to force in anyway but I have nowhere to go. He hits just in front of my passenger front tire and when we break loose he is in front of me. He then slams on his brakes as hard as he can in what I can only assume was an attempt to cause me to hit him from behind which happened since our trucks don't stop on a dime. I call the cops and then wait at which point he gets in the SUV and takes off. I call the cops back to report it is now a hit and run and wait for them to arrive. They get there and while I am talking to the cop here comes jackass returning to the scene of his rampant douchebaggery. He then lies to the cop and says not only that there "was a space to merge into" but that "I sped up when he tried to get over and then rammed him twice once he stopped". REALLY??!!?? The guy in the 40k truck that is 6 months old with $1000 of accessories rammed anything? Cop said he didnt believe his story either but with no witnesses he couldnt charge the . Even though he fled the scene. Appears that if I were to walk into 7-11 right now and stole a candy bar but felt bad and realized I could get arrested and came back and returned it the cops wouldn't be able to arrest me for petty larceny. Waiting for the insurance to duke it out but just had to vent. GAWD! The best bart of some folks ended up a stain on their momma's mattress... Venting is concluded.

how did you resist the urge to take a swing at him? Man its one thing to be a raging douche, but to try and call you out in front of a cop...man i may have been in trouble myself for a crime that included a cop witness (pummeling a nova d-bag). I swear, people may say the traffic is worse in NY and LA, but i have to believe the DC area has title for sheer quantity of "clueless d-bag w/ballsy attitude to boot".

Aside from not having enough to cite the other driver; did the officer at least take an A/I report, wherein he could put in writing, his opinions and conclusions, as to the primary cause of the accident....including the fact that he first left the scene, without ID'ing himself, and then later returned?

I would be really pissed off, given the scenario you describe!

I didnt get out of the truck to go talk to him and was waiting for the cops to arrive so that I wouldnt beat the **** out of him. Didnt trust myself. Cop didnt do a report at all just gave each of us an "Information exchange form" cuz apparently that would be too much like work. If I had been thinking clearly I would have demanded his sergeant respond when he refused to cite the guy for improper lane change and fleeing the scene.

If I had the $1300 that fabfours wants in this area I would have added the steel bumper, grille guard, winch mount by now for the protection. The back end of his tribute is f'd up without it. Wish I had been able to stop in time, I JUST added the lights and bar and got it where I wanted it...

Normally, and depending what the law is in your state, an officer cannot cite for an infraction or misdemeanor which is not committed in his presence; however, he could file a complaint, as a component of his A/I report, and recommend to the DA or City Attorney, that a complaint be filed (citation issued and mailed to the party) if the DA or CA concurs with the officer's findings.

But then again, as there were no injuries and due to budgetary cutbacks, many jurisdictions, even here in CA, are not taking property damage only, A/I reports; and as in your case, they will just have the parties exchange info.

I would take some good notes, to refresh your memory, when you talk to your insurance guy who takes the detailed statement of fact from you in the next few days.
