my two cents.... leaving a scene wont hold up in court, unless of course your an *** to the cop or judge.
He hit you , so he should be charged with following to closely and possibly unsafe driving or what ever it's called there. Unless drinking or some extenuating circumstances are involved never is someone charged for someone else rear ending you. The rules are quite simple keep a safe distance back at all times.

Common sense would say if you got "rear ended", didn't feel the hit and kept on your way, there shouldn't be an issue. They could go on a perfectly legal, sadly BSing thing though and charge you with leaving an accident. Did the guy in the prius attempt to stop either?

lol you make me laugh sir. im guessing it didnt do anything to your hitch? and ya get a lawyer and say no more until they decide to press charges then say nothing till you talk to a lawyer. they CAN and WILL turn what you say around and use it against you. trust me i know.
but thats total bullcrap. stupid prius driver. ppl have to learn not to mess with trucks that are twice theire size cuz we will hit them and sometimes not even know.

no problem buddy. did i tell you about my mom's car gettin rear ended in chicago? we were in the yukon XL and a guy in a small sedan ran up on us. he had a major 3"x3" hole in his bumper, us, not even a scratch. when we pulled over he said it was his fault and not to worry about it.

That kind of stuff happens. In my work truck i stopped at a yield to let traffic go by and some lady hit my hitch and I didn't even feel it. I was checking traffic and saw her step out of her car and noticed the proximity of her vehicle to mine and got out also to look at whatever it was she was looking at. She was looking at her crumpled hood and bumper and i didn't feel a thing.
I could have gotten into a lot of trouble for driving off from the scene in my work truck, and I never felt her hit me.

I had somethin similar happen once. I was in stop and go traffic (under 10 mph) going through the gate at a military base. Anyway, I pull up to the guard, show my ID and the back of my truck raises up a little bit. This ******* in Dodge Intrepid gets out and starts raisin hell, askin for my insurance and all kinds of stuff.
I said "You hit me, I ain't giving you my insurance!" he bout lost his mind. Anyway, I left. Later on, he called the MP's and tried to get me for hit and run. I explained to them "I was stopped, not moving, and he hit ME from behind! I am just being a nice guy not asking him for insurance since he only bent my ball hitch a little bit" (It was already bent but I was making a point)
They told the guy to go take a hike. Oh, and he had a scrape/hitch mark from his bumper halfway to his windshield.
Moral of the story: BUY A HITCH! Even if you don't tow, it's a great rear end protector.
