Not saying you're wrong, but there's a good handful of vehicles that come with the "pulse" third brake light stock now. Mostly imports that 've seen, but regardless, new vehicles wouldn't be able to be sold STOCK if it was against the law...

Think about it this way: If it's annoying it means it's doing the intended job and grabbing your attention. I'm pretty sure I've posted before that I have one on my Corvette; it's so low it's easy to overlook, what with 80% of drivers today being distracted or simply not paying attention. Mine is "smart". It pulses one time (5 quick flashes), then goes solid. It won't pulse again unless the brake lights go off for more than 30 seconds.

The standard steady on brake light requirement worked fine for over a hundred years. 3rd brake lights weren't even required until '86. Drivers have to pay attention.

I think they are more about "look at me" than warning someone that traffic is slowing or stopping.

I have a pulsed light from Morimoto, it's 3-4 fast flashes then steady, it's not "smart". I think smart features are either neutral or positive. I've recently seen some very exciting variable pulse lights...couldn't take my eyes off of them, heh

This is not an opinion.

Distracted driving is the primary cause of rear end collisions, a pulsing light could definitely initially assist in grabbing someones attention, THAT'S WHAT IT'S SUPPOSED TO DO. If some drivers need a flashing red light in front of their face to help them do what they should be doing anyhow, so be it. IDGAF if anyone is annoyed, I don't want to get rear ended by some ignorant pinhead that will ruin my day, cost me money and time, and possibly worse. FWIW, I don't get annoyed by whatever flashing taillights people have, I enjoy bright, flashing, colorful lights. Reminds me of clubbing days and girls in tiny dresses.

Can't fix stupid is true, can't idiot proof 100% of everything 100%.

I think I know what you're referring to with the attention getting...I see that with truck under tailgate light bars on beater trucks with 3 different colors, sequential start up sequence that runs continuously, etc...

I got stuck behind a SUV with one of those in a drive-thru with no exit room in a slow-moving line. Man that chit was annoying AF.

My 2025 STX came with this stock or at least it's listed on the sticker. I've never been behind me while the truck is traveling down the road and I've never noticed it flashing on very dark country roads either.
My dealer stated it only actives under heavy braking but idk?
