The good thing about the BBB Autoline program is that I can still sue using the lemon law / NYS Attorney Generals office if I do not accept or agree with the offer or arbitration results. The decision is only binding on the manufacturer unless I accept it. So lets see what happens here first. Lawyers take 6-12 months or more.

???? Is that the DMV in California? There is nothing to report. DMV in NY has nothing to do with this unless there was a fraudulent deal, or they refuse to provide work order copies. Attorney General handles Lemon Law in NY.

I've been looking for an update on this, for a few days. I would've turned in to a hermit in a bomb shelter by now If I didn't have my truck for this amount of time.

I worked my way through undergraduate school as a part time mechanic at a Ford dealership and learned some interesting things. You would be astounded to find out how easy it is to turn over an engine with no compression and no springs holding valve assemblies in place. By hand!

Someone has really dropped the ball here. I have my own personal opinion on who and where, but it is not relevant to your issue.


I would consider giving them until the 15th to get your truck replaced or fixed. Then it will be time to get your local legal folks involved and I do not mean the ones you contract but the ones your taxes pay for. Civil litigation is nasty, expensive to the plaintiff, and not always successful. That being said, other legal ramifications make big waves.

More bad news.

An engine was shipped, but when the dealership removed it from the truck, the block was tipped over in the crate, and the valve cover was smashed.?? Dealership says they refused it, and have no idea when they will be able to get a new one. We are at 37 days today.

I can't find an attorney to take this case. Only one out of ten I emailed from the consumer advocates.org website has responded and he is in long island. He said he won't travel here for court but for $400 he'll send a letter to Ford on my behalf. He won't do this on a contingency basis so I'll pass on him.

I started a case with the BBB Autoline process. Fords immediate response to the replacement request was that the wanted to inspect the vehicle. Obviously, it is at the dealership for weeks..so they should inspect away. An Arbitration date is being scheduled, but get this - the mediator told me if I continue to allow Ford to fix the truck and its fixed by arbitration...it doesn't matter if its been there for 50 days, the arbitrator may side with Ford since it's fixed. She then explained if I don't fix the truck, the arbitrator will likely issue a repair as the remedy, again...number of days is irrelevant. She also told me I'd have to get the truck 50 miles from my location to the arbitration either driving or towing for the arbitrator to inspect it. Seems pointless if the engine is bad, as they can't tear it apart or start it to inspect it. Just another way to discourage or prevent the consumer from winning. BBB is funded by the manufacturers. She also told me I needed evidence (not opinion) that the value is diminished due to the issue, or the replaced engine.

In NY - Lemon law seems clear - 4 repair attempts for the same issue with it still present after the fourth attempt..that is a significant issue effecting value or safety, OR 30 cumulative repair days where the vehicle is unavailable to you - within 18000 miles or 24 months.

Last week Ford shut down operations in Florida (Customer Service) and won't return to full staff until next week. The last time I spoke to them was 8/28 and they said they would submit my reacquisition request.

So..I'd recommend staying away from BBB Autoline program as they are funded by the manufacturer.

My only option now is arbitration via the NY Attorney Generals process. They do not require the vehicle for inspection, and you can request a documentation only arbitration. We will see.

So here I sit, with my truck at the dealership after 37 days - no closer to being fixed, the seat is stained, and the fender now scratched. It could be another month before an engine is received and installed, and I now have to start over with the AG Lemon Law arbitration process.

Disappointed in Ford, the dealership, and the BBB - It seems like the cards are stacked against you in NY.

Man I am so sorry to hear about your troubles. My girlfriends Jeep renegade went into limp mode THE NEXT DAY after we drove it home from the dealership with like 84 miles on it, spent the next 42 days at the Jeep dealership with a "regional field service engineer" finally handling the complete harness replacement and stereo replacement. It was a severe irritation but the dealership had her in a loaner Grand Cherokee after day two and we took it on a 3200 mile road trip. They were a little upset at the mileage but in our case it was great because the Renegade is a lease. It was just the one year purchase anniversary with two more to go. It still has odd things and has refused to start a couple times.
Jeep has been pretty great though. They gave her 6 oil change/detail credits and paid the first payment of the lease. Customer service is everything when the **** hits the fan.

Keep your chin up. If you end up with the truck and it runs and drives and they repair it, demand a cost out on the biggest warranty they offer and oil changes and hopefully you'll never have to deal with them again.

Lord have mercy. I am going to go vomit after reading this thread.

Why on earth did I just buy a 2017 3.5......I wish you the best my friend. I had a 2013 with timing issues that never were resolved and denied repairs after 60K, even though they should have been covered in my opinion. We are at the mercy of the FOMCO machine.
