The reality is that a good portion of the people on this planet are simply stupid. Then there is another portion that aren't stupid, but don't give a crap about the safety of themselves or others, including their loved ones.

If I knew a vehicle was 2,000 - 3,000 pounds over towing capacity, I'd find a way to flag law enforcement to that fact.

I'm not sure he is actually over when it comes to the regulations. If he has the trailer loaded to only 8-10% Tongue he MIGHT squeak by on GVWR and if so he would on hitch (which they don't usually weigh). The only thing they would do is weigh him and if the truck is under 7,000 lb (and axle weights) and the trailer is under 14,000 lb (and axle weights) he is legal (GCWR is the sum of the Truck + Trailer GVWR).

It can be done legally if he sets it up right. For those who get upset about this stuff, it really depends on how you set it up and how you drive. There is no magic set of numbers that are "safe".
