Unhappy Had a Wreck

I was leaving friends house this past Saturday night at 2am (technically Sunday morning). I guess there was an accident on 45 rounding downtown because traffic was stopped. Had a buddy with me and I laughed and said "probably some drunk screwed up and wrecked". I then went ahead once I came to a stop and turned on my hazards just to warn everyone. 20 seconds later I get hit and thrown across two lanes. Ends up an F450 utility truck didn't slow down at all and hit a Honda Civic that was in the center lane (I'm in the right lane) at approximately 65mph. It shoved their car into the drivers side rear of me, pushing me forward and the front of me into the center lane where he then struck my drivers side front fender area. The poor Civics trunk was in their back seat, and front bumper was at the windshield. I thought they were dead, but by the time I got out and realized they weren't in the car, the wife was standing by another vehicle and the husband was trying to kick in the guys door and punch the window in.

No one was seriously injured, and I would hate to be the guy that caused the accident. He was working and in his company truck that totaled one vehicle and more than likely my 9-month old truck. I'm having my insurance take care of me and throw the bill at his insurance since that is the fastest way back into mine or a new one. My rental is a 2013 fully loaded Taurus.

At this point I really hope they come back and say it is totaled. It looked as if the rear of the truck might have a bent frame. It definitely needs new front and rear doors, a new bed, rear bumper, tail gate, both drivers wheels, front fender, rear glass and front and rear suspension parts. The bed is shoved into the cab of the truck. When I tried driving it, it made a weird noise up front. The pics don't do the trucks damage any justice. I'm not going to accept them saying they can fix it all. It is a spotless brand new truck, and there is no way they could return it to me the way it was before the accident. The adjuster is going to look at it tomorrow.

We will see. My insurance has already stated if there is any frame damage and suspension damage they will total it due to it never going to be 100% the way it was before. Thanks!

Wow, sorry to hear about the wreck!

Unfortunately I think you're being a bit unreasonable about the repair. Every part on your truck came from somewhere else and was bolted together to form what you bought at the dealer. I'm not sure about the laws in Texas, but in many states they will replace a frame as long as the cost isn't above a certain threshold.

Your truck most certainly can be fixed just the way it was, and to demand a shiny new truck because you had the misfortune of being hit seems like an overreach to me. Perhaps you'll get "lucky" and it will be totaled, but if that doesn't happen it should get fixed the right way and you'll be none the worse for wear.

Where did it happen at? It was raining today in Dallas and I was scared to drive. Seems many Texans have issues driving in any kind of weather!

It's definitely quite possible it will just be a repair. But I'm still upset at the guy. How in the HELL do you hit someone at full speed with a million red lights in your face sitting still. Either way, I want to be back in my truck or a new platinum quickly.

Tomb is obviously an insurance adjuster or has his hand in some type of insurance company. It is also obvious since he is from Connecticut which is the insurance capital of the world. Be careful what you say on here since he will be like most adjusters and deny any claims because they are trained to be complete jerks and will do whatever it takes to not pay you what it is worth. Fight hard for it to be totaled and make sure you don't sign anything. Get an attorney if you have to. Adjusters love that.

Honestly if it was his truck he would not think it would be "unreasonable" for his 9 month old truck to be replaced with a new one.
