Default Parking brake problem

When I step on the parking brake it'll click but pop right back up to the top. I have to step on it a few times before it finally grabs and stays locked. I haven't looked at it yet, but wanted to see if it's a known problem and what the fix is first..

Mine has done the same thing since new, dealer says it's normal. I don't use it often so it doesn't bug me much.

As far as I can tell...
Quickly applying the peddle, it will react like an emergency brake.
Slowly applying the peddle, it will react like a parking brake.

I first noticed this after I was rear-ended. Adrenaline wasn't allowing me to slowly do anything, and I could not get that damn brake engaged. After I calmed down, I realized it's operation procedure, and how to apply the parking brake properly, slowly.
