It is my understanding that at least in Florida- Uninsured motorist insurance covers medical expenses related to accidents cause by someone uninsured. The damage to your truck is covered under your comprehensive. Imagine if this was a hit and run, you're saying insurance wouldn't pay for the damage to the vehicle or if you lost control and ran in to something??

Hopefully the OP will just let his insurance company take care of everything. If anything is to be gotten from the at fault driver, the insurance company will do it.
That's what we pay the big bucks for.
As for the court order vs search warrant; 2 different documents used for totally different circumstances. One can be a single sheet of paper with little cause. The other requires a specific item or items to be searched, an affidavit explaining why the information is needed for furtherance of the case, and a face to face, or telephonic conversation with the judge.
Without any serious injury or death, or no signs of alcohol or drug impairment, a judge would probably let the officer know he's wasted his time. Or if he's nice, just hand the warrant back and tell you to find me more.
