When near GVWR, is weight distributing hitch neccesary above 7k lbs?

Why not do an actual test as per the trailer towing guide? Just like with the WDH, measure the front, load up the tongue weight, only rather than a WHD, see if you can get the front measurement in spec by adding weight in the cab.
Can you do it without exceeding either payload or RAWR? My money is on no, but rather than a bunch of speculating, just give it a try. The scales and tape measure will tell all.

To get maximum effect of the counter balance it should be placed as far ahead of the front axle as possible. Doing that with "passengers" probably is likely to violate something else in the motor vehicle code depending on your jurisdiction.
