Google legal trouble from towing over pickup truck limits. Basically you are OK until you have an accident. The worst the accident, the higher the liability.
There are several articles that point out liability and negligence, but a good majority of them have claims to requirements but no following information as to WHOM requires it, such as the 5000 limit before WDH is required. There is also the gray area such as boat trailers and farm wagons that weigh well over 5000 pounds yet have very low tongue weights and no means of actually connecting a WDH to.
