I'm at 42, 316 miles, pretty sure I'm out of warranty ?!

depending on when your warranty start date is you might be. that is covered under 5yr/60k mile powertrain. If you have your VIN i can tell you for sure

The rattle happens at startup and can last one up to a few seconds.

It lasts 5-10 seconds and sounds like a valve or lifer tap, not really a rattle.

Get rid of that crappy oil filter and put a quality one on there.

Just installed a new Motorcraft filter, still doing the same thing !
