3rd brake light

Exclamation 3rd brake light

Would the light in the white circle be concidered a "legal" 3rd brake light replacement? It is about 12" by 1" in size with 9 small LEDs. It is on my back rack pretty much right above the original 3rd brake light. Let me know what you all think.

I'm not sure why it wouldn't be legal, It lights up red.

Mine is about to get covered by headache rack, most states don't require you have a working 3rd. For instance in Texas the laws clearly state that you must have at least two working brake lights if the vehicle was made after 1964. If prior to 1965, the vehicle is required have at least one brake light, and that the one be mounted on the drivers side. Nothing is mentioned about the 3rds. Now that law and the third has kept me out of tickets with vehicles with an independent stop and turn bulb when one brake light in the tail goes out...

I know there is a US DOT law that says it can't flash, but I think everything else is left up to the state to decide.
