Anyone who sells a vehicle must comply with the law, so if the dealership puts it up to auction and it sells, they've violated the law and the new owner can take action against them (and report them). If they sell it on their lot they have to make sure it complies with the law.

I'm never trading in this truck to a dealership because I'm keeping this truck till the wheels fall off and engine craps out. I plan on buying a newer truck "2012,2013" in a few years and I'll keep this truck as a work truck, So to answer your question When i do finally get rid of it I'll either sell it locally on craigslist or just trash it

Beyond all the legal nonsense, I had until last year a '96 F150 5.0 that I hollowed out the cats on. I did not improve the sound, more importantly and what I my goal was, it did not improve performance. Two months later I regreted my decision but was not going to spring for a new y pipe. Still put 150K and ten years on it.

It won't be "legal nonsense" when it hits your wallet for fines if caught.

Another note; traded in the wives car this weekend at a dealership for a new one. One of the papers we signed amongst the pile of others was a statement that we did not tamper or remove any federaly required smog equipment. I asked the finance officer what signing this paper meant in the way of my liability; she stated that the dealership will require me (at my expense) to have any of this equipment placed back on the car before they can sell it.

Watch the papers you sign when you trade it in.

And selling it to a private individual via any newspaper or Craigslist (or other source), even with an "as is" clause in the bill of sale does not exempt you from these federal laws.

Well as I said before I don't plan on trading this truck in to a dealership because other than maybe putting it on craigslist..... I'm keeping the truck until it falls apart and needs major repairs "new motor, transmission" when something like that happens then I'll get rid of it by scrapping it, they wouldn't say anything because it's not getting sold back to the public. It's gonna be crushed, torn apart then melted down. they're only concerned about things like the gas tank being pulled out
