The manual specifies changing it at 150,000 miles. If you're there, then it should be changed. If not, then the dealer is trying to sell services that aren't needed, and Ford asked them not to do that last year with a letter. It can't possibly need changing at 44,000 miles.
Always check your manual before you bring your vehicle in (and keep a PDF version on your phone). Dealerships regularly try to sell services that aren't needed.

I am all about preventative maintenance only if its needed and makes sense. Years ago I worked at a quick lube shop while I was in college. They routinely sold unneeded services to people who didn't know any better. They would have the pit guy dirty up fluid to show the customer. It was pretty shady. I didn't stick around very long.
Where I am going with this is do what Ronald Reagan used to say. "trust but verify"

I went through this too. That term "Torque on Demand" is a joker in the deck because it only shows up on the fluid specs page. In the operations section they call it the "2-speed automatic transfer case" or something similar. I have the same T-case and it does indeed take LV. The eureka moment was when I went under and saw a sticker just below the fill plug that states "use fluid type LV only".

Most of the fluids are pretty cut and dry. "Use this" This one on the other hand took a little detective work..

I'm still wanting to learn more about how using Mercon V in a transfer case can potentially cause it to "explode". I want to see if Ford actually published literature using that word. If so it's an interesting matter, because they didn't say "severely damage". Makuloko claims Ford uses the term "explode". I understand all about detergent packages vs. clutch friction materials and even the possibility of clutches de-bonding, but "explode" has me intrigued.

When I crawled underneath there there is a tag that says LV fluid on the rear of the t case. First thing I did was remove the fill plug and check the fluid. It was dirty. Drained it and filled it in under 20 mins. Thanks for everyone who chimed in and help answer the question.

If it's TOD it'll have a 4A position on the shift ****. In that case it takes Mercon LV.
