Yes, going to 'jail' for this violation, absent some other associated factor, e.g., an outstanding arrest warrant, DUI, or unlicensed and no proof of identity, would not happen (at least) in California; wherein, the jails are too full, and the 'system' too busy. Therefore, it would serve no purpose.

In CA, you will be cited (not necessarily a fix-it ticket) if the following is violated:

Can I put after-market tinting on the windows of my vehicle?
The main requirements for legal window tinting in California are:
  1. The windshield and front driver's side and passenger's side windows cannot receive [any] after-market tinting.
  2. If the rear window of a vehicle is tinted, the vehicle must have outside rearview mirrors on both sides.
The law prohibits any person from driving any motor vehicle with any object or material placed, displayed, installed, affixed, or applied upon the windshield or side or rear windows....However, you may tint the rear window, as long as you have both L and R outside review mirrors.

There are two reasons behind this law. First, during periods of limited light and/or visibility, e.g., darkness, fog, or other inclemate weather, there is a safety aspect for visibility while driving.

Next, and IMO most important, is officer safety! The driver of a vehicle on a highway must be visible to an officer...day or night.

From an LEO perspective, think about approaching a vehicle, and not being able to observe who is in the vehicle, what is in their hands, or make any visual observation of the driver, upon approach to the vehicle.

Furthermore, no automatic pass for an out of state vehicle; it is the officer's discretion, based on the totality of the circumstances.

They're ranked 17th in unemployment according to the BLS stats. Still, I wouldn't mind moving there if the opportunity arose. I travel there all the time for work and the food alone, the sheer variety and quality makes me happy

Go to North Dakota if you want true wild west with absurdly low unemployment. Hell, they may not even care about the window tint!

I believe there is a difference between tinted glass and tint film on the glass.

Odessa/midland area has some of the lowest unemployment rates in the country, why? Oilfield like in the dakotas, specifically, water hauling im pulling in 4 figures a week from water hauling, its alot of work and $$$ and dedication though, on the other on topic hand, I WANT DARKER TINT! Damnnnnnn

All cars with AC have some tint on all windows. (Which is probably all cars today) This helps keep the interior cooler so the AC does not have to work so hard.

Just got pulled over tint read 17%, illegal tail lights, third brake light and no mud flaps. Now c'mon piggys I go to work all day have always kept a job pay my taxes support the economy, and I'm the one who gets two tickets for the retarded stuff around. I'm sure there was a couple stabbings or a shooting but better let those idiots run around some people's tint is to dark pfffftt tax payer money well spent thumbs up to all the chitty police out there have a nice day.
