Around here it's is the same. The land owner has one chance to tell you it is private property whether it be a sign or he verbally tells you. If you refuse to leave then it is trespassing.

up here they shoot at you that's why there are fences up and signs all over the place, the guy should post some signs up.tearing up a field is still just plan stupid there are mud holes and off road parks all over this country go to them and have a blast. power line trails are no place for off roading and its a $500 fine if you get caught coming off one of the trails here.

My dad (lawyer) was explaining this stuff to me the other day and it is the landowner's obligation to post it as private property and wouldn't be able to prosecute you without a clear sign that you are trespassing. This came up because a guy was killed when he rolled his atv on land that he was trespassing on but it was not posted so now the family has a legal right to sue the landowner because the land wasn't marked.

So u made an honest mistake. happens all the time. at least ur sry for it. and true though the guy dosnt deserve to have his land torn up if its bin a problem for him in the past he should have a sign up or somthing, lets face it, depending on were u live a good 4x4 trail isnt always on hand and once word gets out of a good spot 4x4s will come. but dont beet urself up to much. I took a girl to her house once and when i left i asked if i could do a donut cause there was about 10 inches of snow on the ground. long story short she didnt own the place and the donuts i did tore the yard up pretty bad, her dad was pissed and i felt bad after the snow melted and i saw the ground. ur not alone bud

The family sueing the landowner for the death of a family member on a four wheeler is in no question wrong. Courts should never allow this to take place. It is terrible that the landowner would have to even defend any actions taken while first, the person is tresspassing (posted or not). And second the person on the four wheeler assumed a risk when using or participating in the acitvity. The family has a loss and thats terrible. But in no way should benefit from the accident. It is an assumed liabilty if you participate in something that even remotely has a risk, you should not nor family be able to sue anyone. You took the risk and sometimes you loose...
As far as the OP forget about it in most places even if the landowner complains to a Sherriff it will result in you getting talked to by the Deputy. Courts really dont have time for this nonsense. Your right you should not have done it, period. Just dont do something stupid again. But dont stress over it, people will do stupid things sometimes, its how we learn..

best thing todo in a situation like that, is NOT try to run away like you did. stop what youre doing, shut your truck off, get out, and approach the guy on foot, and be nice, apologize , say you had no idea, be honest. the second you look like youre trying to run away and take off before they get to you, thats gona **** anyone off . if someone is coming with the intentions of being nice and just asking you to leave, then you get in your trucks and book it, that persons attitude might change a lot and they might get the idea of then calling the police now that youve pissed them off.

I wouldn't worry about it too much most likely if you apologized he won't call the cops bless you do it again. Even if he does they might come to your house and ask you about it but probably just a warning. It's happened to me in the less than a yer I've had my lisence.
