But as an officer, I just suck it up and pay the fine. It may suck but technically if you did commit the infraction, he has legal right to fine you.

no offense officer... I would need to see documentation stating when the radar gun you used was last calibrated.
maybe the law here is a little different but I don't think there is a court in the country that would not throw out a ticket for one mile over.... talk about a waste of tax dollars.. tell me it's not quota time... " Sorry.. just my rant.. no offense intended"

That aside, as I said, I wouldn't even consider pulling somebody over for going 1MPH over, let alone write the ticket for it. But at the same time, the more loose people get with laws the more people will try to stretch their chances. It happens with everything. "Officer, it's just a little weed." or "Officer, I only pushed her 1 time". 1MPH over the speed limit is different severity than those examples, but the idea is the same that people will just push the limit
We as human beings have that self entitlement that we grow up and learn that we feel that the speed limit is actually 25mph+10mph buffer zone where I'm invulnerable to getting pulled over. It's called a SPEED LIMIT(maximum), not a SPEED SUGGESTION.
I'm just saying, people, ALL PEOPLE (cops and all) are constantly trying to push the limits to what they can do and get away with. It's my opinion that the people with enough common sense will step back and say, "Okay I will take responsibility for my actions."
And just a Public Service Announcement, my agency DOES NOT have quotas, nor have I ever seen an agency that did have a quota.
And in a lot of people's opinions, EVERYTHING an officer does that doesn't help their situation, is a waste of tax dollars. If I pull over people for running stop signs, people ask me why I'm not catching people with drugs. If I'm looking for drugs, people wonder why I'm bothering them (or supposedly violating their constitutional rights that they don't even know). If I'm not bothering anybody, I'm wasting taxpayer money by not being proactive. I learned as an officer that you can't make everybody happy, but you make the best decisions you can and have good intentions. I can honestly say that there is no idea of what it's like to be a police officer until you become one, because when I was an angry teenager, I had the same beliefs that I just described. That was my rant.
PS, I've never pulled anybody over for 1MPH lol But it is your right to contest the citation, so more power to ya!

One mph over IS speeding. You would pay the fine for the 1-9mph over the limit bracket. As it was already written, it's a speed limit not a speed suggestion.
On the other hand, show me the person that doesn't occasionally drift +/- a few mph.

If you were stopped for 1 over you can bet it was an excuse to check you or your vehicle for compliance if you were cited you can bet it was for attitude not speed most depts wont cite for any thing less than 10 unless there is an attitude problem.

I'm in agreement that 1mph is over. If attitude was a-OK, I can't believe getting a ticket for it. I don't think there's a speedometer out that that's really accurate within 1mph throughout the entire band on it.

Found a Texas law that says commercial vehicles have I have a speedometer accurate to within +/- 5mph @50mph.
Can't find any laws about speedometer accuracy for non-commercial vehicle.
