I just got in touch with Torrie from Unleashed witch by the way he is awesome, super fast response to emails.
But he tells me that Yes it can be done and it's based on output shaft speed which you can log. He also said it may take a few revisions but he can get it done.

Yes, Part Throttle shift points are set by mph while WOT shift points are set by both RPM and MPH.

I also contacted livernoise and here is there response

thanks for your interest in Livernois products, depending on fuel run the addditional HP should help in this area, we can not out gears by MPH

When i looked at mine in HP tuners it's done by output shaft speed.

Got my STC BDX for unleashed Thursday last week told Torrie what I was looking for he sent a tune over within minutes and told me to drive it see where we are at with the changes made.I drove it for a day and noticed that the changes that were made was a touch off. I emailed him around 9pm Friday and within 35 min I had a new tune send to the cloud to DL.! Loaded it the next morning took it for a ride and it's really close to where I want it. I think one more change and he will be on the money.
I got to say Torrie is great I would definitely recommend unleashed to anyone looking for more power and or the MPH gear lock out like I was.
No more bogging in 5th at 35mph she don't shift into 5th till 40-43 mph.!
