Please note the if the airbags deployed, that could be a $2500 to $3600 "repair" cost, while the damage i see, is 1. replace front plastic surround, about $1200 in parts and paint, 2. lower A frame, ball, axle, wheel, possibly the top A frame, at about $2000. So, expenses could exceed the 40% of worth the Insurance industry uses as Salvage value for scrapping a vehicle) plus, several states, too! (I am in Florida, which uses 45%...)

If you leave because of some teen aged idiot couch potatoes posting their backwards over views of battles we have fought, and won, then it, will reduce the number of brave warriors on this battle front.
Glad you got the settlement for your truck. hope you got a really aggressive attorney, to get medical settlement that is proper! Find a genuinely aggressive lawyer who used to work on "their" side!

To those that are saying this guy was at fault or was even remotely neglegent for not slowing down, you all are idiots. Bottom line, the OP was in a controlled lane of travel, separated from other traffic by ****ty traffic control devices. An equal idiot circumvented those measures and was penalized for it. Did the OP receive a citation for “unsafe speed” (a citible violation when speeding didn’t occur but unsafe actions for the conditions were displayed- which, given the circumstances- any officer would have gladly issued if they mirrored your sentiments)? Nope. Why? He was going less than the posted speed limit and was nowhere near at fault. How do I know it was less than the posted speed limit? Having been stationed in SETX and being in Houston many times, most interstate speed limits are 70mph. For grins, I’ll assume it was 65 on this stretch. Still, you can see by how fast he was passing the stationary cars that he was probably going ~ 50mph.
Take your opinions and shove them. The OP got his truck smoked by an inconsiderate, impatient, and unattentive driver and was rewarded by the insurance company with a new 2018.

Thanks for the kind words everyone. Yep, sucks about my truck but I am so thankful that everyone is okay. I know it could have been much much worse.
The dash cam is a spytech a119 that i got from amazon. I still haven’t been able to speak with my claims representative, but I’ll try to update the thread once I have some more information.
For those reading, go double check your auto insurance policies and make sure you have uninsured/underinsured motorist coverage. I do, and it may end up paying off big time. Also check you liability limits and make sure they are sufficient.

I carry .5m for both liability and un/under insured. Was in a bad accident many years ago caused by an uninsured motorist. Medical bills alone were well north of $100k. Thankfully we had the additional coverage that covered it all. Only costs about $50 extra per year to carry that much.
Also as a reminder, make sure you have medical payments coverage in your policy. I found this out the hard way when my wife was rear ended by an uninsured driver and had to go to the hospital. We racked up a few thousand in medical bills and had to pay out of pocket until the claim was resolved. We had uninsured motorists coverage but since we didn't have medical payments coverage, they wouldn't pay the bills as they came in, we had to make them and then get reimbursed. This is for CA so it may or may not apply to other states.

Hitting someone that pulled out in front of you is not your fault.
Driving the speed limit even when the lane next to you is stopped is completely legal.
The only time this is an exception is when there are emergency vehicles with flashing lights in the next lane over, and here, the law is you must slow to 60km/h in this case.
The other driver was just an idiot and completely at fault, plain and simple.
I can't count the amount of times people's dumb moves almost cause accidents. There's an exit I pass every morning that gets backed up almost a kilometer onto the 3-lane highway that has a 100km/h (60-mph) speed limit. That lane is always a crawl and sometimes stop-and-go. Impatient idiots are always pulling out of that lane to get ahead and squeeze back in closer to the exit. Them and the other idiots who don't want to wait in line will drive down the middle lane passing the line of cars until they get close to the exit when they put their blinker on and almost come to a stop IN THE MIDDLE LANE so that they can squeeze in between other vehicles in the right lane.
As I'm always in the middle lane at this point, it drives me crazy because they're just being impatient and don't want to get in line like they should. So now me and everyone else in the middle lane is also almost coming to a stop because of this idiot. Highbeams and laying on the horn, far too often. A few times this at least resulted in them continuing on instead and finding another exit...
Yes I still do the speed limit anyways.
Yes I'm being very watchful of that right lane for someone trying to pull out.
Yes I always expect the lazy idiot to come to a stop in the middle lane to try to get to the offramp.
Yes whenever possible I move to the far left lane but that's not always an option in heavy traffic.
Yes I have a dashcam in case something like this happens to me.
Congrats on the new truck OP!

anyway talking about defensive driving, which is what the majority of these posts are, is hardly blaming the guy for having some moron pull out in front of him.

On the contrary. Incessantly pointing out “hypothetical” situations of what someone could have done or how someone could have altered their actions to avoid the situation the OP was placed in lands you directly in the land of passive-aggressive criticism.

oh, well in that case, it's completely his fault LOL

Right on Lenn!!!!
S*** happens. Like last year, I sure didn't expect someone to lose control and slide across my lane. My speed was higher than I wanted it to be, but I had it under control that when I reached the intersection, ice or not, I would have been ale to stop. The road up to a certain point was just wet, then at a tree line, it turned to ice. Arm chair QB would all be saying, You drove too fast. You weren't there, you don't know what the roads were like leading up to it, just like you don't know what it was really like the day some moron pulled into his lane, all you see is what was directly in front via the camera. You have to remember that the driver has a much wider view and can see a lot more than what was recorded, and would know whether or not conditions warranted the speed he drove.
The night of my crash, I saw the headlights move slowly sideways long before I got there, and was already slowing as I could see that the road looked different up ahead, and was lightly braking, enough that I would be able to stop, but once I saw the light cross the line, it was too late to avoid it, I was on ice, and there was nothing stopping me, or him. He got a ticket too and was at fault.
