Tough looking damage.
The wrecked one was totaled, and rightly so, I'd say.
You noted a new one was "set aside".
When do get it? Same basic truck, two years newer?
Comments on your insurance companies efforts?

so all these numbers you guys are throwing out about insurance? what are they? liability caps?
is it crazy that both of my vehicles have a liability cap of $2,000,000? is this just a Canadian thing? because some of the numbers i see would not cover either of my vehicles or any injuries incurred during the crash.

They are still flipping that back and forth. I have no say in the matter.
Correct. I found the one I wanted and the owner pulled it off the lot and set it aside for me.
When the wrecked truck has been settled. Correct
My insurance is not involved as of yet.

It is really pretty simple. Louisiana mandates compulsory insurance coverage for all vehicles. The minimal limits permitted by law is a $15,000.00/$30,000.00/$25,000.00 coverage limits policy. This means if you are the “at fault” driver then your insurance company provides coverage to that vehicle, and any driver that you give permission to operate your car who you have not previously listed as an excluded driver, up to these limits. More specifically, if one person is injured due to your fault then that injured person could recover up to $15,000.00 for the injury including all medicals bills, lost wages, and pain and suffering. That is the first number – $15,000.00. If say for example four people were injured then the second number comes in to play ($30,000.00) and this means your insurance policy will pay a maximum of $30,000.00 total to be split between the injured parties with no one person receiving more than $15,000.00 (ie. the first number). If the most severely injured person’s injury is worth more than $15,000.00 then the policy would pay that person the $15,000.00 limits and the remaining three injured plaintiffs would be forced to split the remaining $15,000.00 because in no circumstance would this policy pay more than $30,000.00 total (ie. the second number). Obviously, this scenario makes it very possible and perhaps likely that the insurance policy is insufficient to make all the injured parties whole therefore exposing the insured to an excess judgment. The third number, $25,000.00, is the total amount of coverage the policy provides for property damage. You may have noticed this means the Louisiana legislature mandates more coverage be available to fix your car than to fix your body.

our $2million liability coverage cap includes all of that. 1 accident could definitely cost a hell of a lot more than $30k...

Three years ago my son rear-ended the car ahead. Freeway express lane. Totaled son's car, don't know about the others. We have $100K insurance limit. Three cars, the vehicle ahead of my son ran into the vehicle ahead of him.
- Son 100% responsible for damage to car ahead.
- Guy ahead 100% responsible for damage to vehicle ahead of him (I'm thinking of that "gap" thing being noted in previous posts).
- Guy's insurance call me and asked for our limit. Huh? I called our insurance and asked if I should give him our limit. Was told this was normal and to give it to him. Okay.
- Guy ahead of son sued us for whiplash. My insurance offered $80K. He turned it down.
- I specifically asked if I was liable for any amount over $100K. For reasons I do not understand my insurance said that, because of the circumstances I was NOT liable for the amount over the $100K. I did not, and still do not understand.
Think my company told his company to accept the amount offered or they would go to court. BTW, the whiplash was for the guy's wife. My son was not even sure there was anyone in the vehicle except the driver. It was rush hour, dark (November) and traffic was bump-to-bumper. Everyone was level headed and stated they were okay at the time. My insurance company wanted to see son's phone to see if he was talking or texting ATT. He was not.
