And overriding a system not always is that simple.
The piece that moved to hit my truck stopped right in the line of path of any large vehicle (I believe a small vehicle could go through) and the owner told me only late on the following day it was fixed in one of the conversations.

* Disclaimer: the owner was not my acquaintance, we never met in person and never spoke again since everything was solved. Did call him to acknowledge everything was done with the insurance and to thank his attitude. He gained 2 regular customers for the gas and 1 for the carwash (yes, my wife, the lazy Susan, as I wash mine by hand lol!)

The part you still seem to be missing:

A malfunction with the carwash didn't cause the damage (which appears to be the case for you). It broke, and the owner chose to drive out of it though the sprayshield was still in place, which caused the scratches. Could have just gotten out of the truck and gone and raised hell inside if honking didn't get anyone's attention at first.

That is a whole different ballgame from what you are talking about. I don't blame the owner for not thinking it through in the heat of the moment and maybe it wasn't obvious the spray shield would have caused those scratches at first glance....but that doesn't mean the carwash is going to be liable in the end.

I feel like we're talking in circles so just gonna bow out I still think the owner could probably get a good detailer to take care of most if not all of those scratches for a lot less than repainting.

Social media is a powerful tool. Pay your $500 deductible and post your story with those pictures on twitter and/or facebook, making sure to tag Shell in it. It's likely they'll reply and repay you the $500 somehow, or give you something for your troubles ($500 is much better than $3000, even for a large corp). PR and social media is huge nowadays and something that they take seriously because they can quickly lose customers if the story spreads.

Curious, why do you think they will pay him anything?

Why not? Because they didn’t do anything wrong, the OP did. What you’re talking about is called blackmail.

Posting a story about something that happened to you is not blackmail


And perhaps they should ensure their system has a failsafe so if it shuts down, you're still able to drive out without any damage. Those plastic guards should not be obstructing an exit and you should be able to drive out at any time. What if a passenger has a medial emergency? Are you supposed to wait until the wash is done while someone's having a heart attack?


Calling it blackmail is way over the top

I am of the opinion that if you did run through the plastic flaps & other components while it had stopped right in the middle of the wash, you're kinda responsible for it... I mean, there were other alternatives to simply drive forward, such as getting off your car and exit the carwash by foot. Again, this is just an opinion based on what you wrote. We're not lawyers nor aware of any other circumstances / factors that are required to consideration to establish who's fault was it, since we didn't witness any of it.

Did you try to buff it properly? If it's just the clear coat that's scratched, there is no need to repaint the whole thing - it can easily be repaired.

Get a good buffer, a good abrasive compound and try it on a small area! Buff and buff until that clear coat heats up and any minor scratches will disappear. Don't buff for too long on the same spot though.

Dude..... really a heart attack ? If someone was having a heart attack in my truck i would drive thru the friggen glass doors if i had to......
the last thing on my mind would be hurting my truck.

And if that was the case I sure wouldn't blame the car wash !
