TheOxFx: I, like many who have been discussing you and your original post in your absence, am happy for your update. It's a tough lesson learned, I have no doubt. You seem to have a good attitude about it all, which is nice to see. Thanks for filling us all in.

You and or your attorney would have to prove the mod didn’t cause the damage. Who do you think is going to win?

My position was very simple.... If you tune your engine and it fails don't try to sneak it past Ford to have them pay for what you did. I'd say that's pretty straight forward. Some want to say that's being a boy scout, do gooder... etc! I call it simply being HONEST... nothing more.
Unfortunately, everything in life isnt as black and white as your post implies. Take for example the TSB on the 2.7 engine for oil consumption / engine failure Would your moral compass indicate that if someone is running a tune and experiences this issue that they should be denied warranty for it even though the tune had nothing to do with the manufacturing defect? Im not implying that the burden of proof has to be on Ford to prove anything but I also dont think its as clear cut as you indicate in every situation.

Tmcolegr, any chance you'd be able to post the full Gas Engine Modification doc? The reason I ask, from what I've heard from a few Ford Techs, there isn't any additional information they are able to pull from IDS other than the mode 9 data ignition counter and whether or not the PCM calibration file is stock or not. In order to fully make a case, Ford would have to have them send in the physical PCM for detailed forensics which they informed me they've never been requested to do.
Would just be curious to see what additional information is available at the dealership level. From my understanding it's pretty minimal.

;-)
That information is highly confidential and proprietary, so TMC is wise not to share it.

Yes and no. Ford's engineers can easily show design ratings and explain that they include certain safety factors to account for tolerances across multiple parts so that parts will not fail.
And then you get to try to refute that with some kind of fact other than 'worked fine on Bubba's truck, should have been fine on mine'.

I have read countless stories about owners tossing up the Magnusson act for years. All the manufacture has to say is they think the mod caused or contributed to the damage and deny coverage.
Then what? Dealer says no and you are holding the bag unless you want to go the attorney route. And trust me, the minute you toss out the word attorney they clam up. End of story unless you have deep pockets, lots of time, and a really good attorney. Thats how it functions in real life. Especially when they give you a warranty book and inside it is a written list of what they deny warranty for.

I for one knew it was "risky" running a lot more power, but figured that maybe meant 125k miles vs 150 or 175k and i don't put a lot of miles on my truck at all with my work schedule. So at 20k miles i would have never guessed i could lose a motor. That was my intention. If i get blacklisted here i promise it won't be a life changing event, but thanks for being a dbag anyways
