That depends on where you are, your state laws, and the quality of the person performing the inspection. If you want to know, your best bet would be to go to your local inspection station and ask the guy performing the inspections.

State? In Texas, even in emissions areas around Hou and Dallas, yes. You're supposed to have a muffler, but the chances of them checking as long as the OBDII checks out are next to none.
However, the 5.0s sound great with a small flow-through style muffler, while still being quite loud, and are too raspy with straights.

I put a magnaflow muffler on my 14' 5.0 and i love it.
I did the resonator delete..then a SI/DO magnaflow 14" muffler..with dual exits out the rear.
man it sounds good! and i spent like $450 on the whole thing.
way cheaper than most catback sytems.
