Unfortunately Michigan is a no fault state so her insurance will not cover damages to my truck. The most I can get from her is the 500 to cover the deductible. After talking to my dad (the body shop) he doesnt think it will cost much more than $500 for us to do the repairs so we might just go that route and avoid insurance. I just have to file a claim with the other drivers insurance company. There isnt much the other driver can do to fight it really, the police have it in the report that she was out of control and I had control of my truck so she wont have much of a leg to stand on.[/QUOTE]
I have lived in several "No Fault" States, NOT Michigan just to be clear. Most "No Fault" states are more a percentage of damage reference. For instance, if you are to my left planning to make a left turn from a side street and I am making a left turn in to the side street and we collide most likely neither would be at fault as be both should have had control of our cars and should have provided the other room and fault can not clearly be established both have some percentage of fault. In your case you had no control over the events that took place and therefore the other driver was 100% at fault. If you truely have "No Fault" insurance then you would have the right to sue for damages. I may take a little pushing and some research but the internet is a great source of information and you should be able to locate your state laws and statues to properly present yourself in court if you can not presuade the other parties insurance with the information and knowledge you obtain by looking up the laws and statues for your state with respect to property damages.
PS: Sorry to see and here your truck was in an accident. Remember one thing do not get made, instead find out how to get even LEGALLY..... Most people do not know have a clue about the actual laws or statues that they may give you advance on, as they change often.

Nice that you have a back-up truck to drive. Damage doesn't look too terrible.
