Do those 2 things and you can lemon out your vehicle so long as you follow your states lemon law procedure. A lawyer can help you with that.

I didn't have the advantage of knowing how the truck would perform in warmer weather with the non-winter blend fuels. So my problems started from almost day one with both the falling flat while trying to merge on to the interstate or passing and this shudder/misfire issue.
Watching this thread, I had been hopeful that Ford was actually working towards a fix. But after the latest attempts at a fix and the continued denial of the problem where they want to attribute it to "tires", "tranny learning", etc etc etc. I can't help but think most of this is just a delay tactic to get everyone back to warmer temperatures where the issue will probably reduce to the point where most go beyond the lemon law time/mileage limits before hitting colder weather again.
I too fall into the group where they refuse to acknowledge the problem but continue to work on trying to fix it. They can't duplicate it, but won't drive it. The last attempt at duplicating it they put less than 10 miles on the truck. Based on where the dealer is located they would have barely made it to the interstate and back let alone running on the interstate to verify. I'm pretty sure they don't want to verify because they came back and told me that without being able to verify it, Ford has told them they can't work on it! So it is under warranty but can't be worked on now...

I made sure I got the same Service Manager, but when I asked if they had ever seen a similar problem he told me they had never seen an eco with any problem even remotely like this. I let him go on with that even when I picked it up and gave him another chance to come clean. At that point, I asked the person giving me a ride to pick up my vehicle to come in and say hi. Why? It was the other Eco owner. Want to talk about awkward?
I guess I have been "lucky" in my past because I have rarely been lied to by the service dept at my old dealer. Granted up until this vehicle I have had all my vehicles serviced at the same dealer for the past 15 years. No matter how bad it looked for them or the "brand" they just stated the issue straight up and worked on a fix with me. That has been the most frustrating part of this for me, the lies and run around. Mechanical issues happen, first year bugs happen and those I can deal with. The inability to cope with them isn't something I'm willing to continue with. I started the lemon procedure last week. My truck is still running great. A couple mornings this week it did dip into the 30's and I noted decreased mileage and could feel the "miss". In the afternoons at 60-70 degrees the miss is not present and the mileage is around 20-21 mpg depending on hills/wind. What is making this pronounced at colder temps? Condensation? Programming issue? Both? It is very easy to tell that below about 40 degrees mine will do it, above that and the truck is golden.

Just a quick update from the 55 MPH shudder sticky thread, here are a few numbers;
The number of vehicles in the DB is currently 80, I had some downtime and was able to do a few stats.
Model Year affected: 2011: 72 = 90% 2012: 8 = 10%
Engine: EcoBoost: 72 = 90% 5.0L: 8 = 10%
Wheelbase: 145'': 53 = 66% 157'': 27 = 33%
4x4/4x2: 4x4: 73 = 91% 4x2: 7 = 7%
Trim: I did not break down the individual numbers, however these are the levels affected: XLT, XTR, Lariat, FX series, Platinum. It appears the XLT had the highest number followed by the FX series and then the Lariat.
Assembly Plant: Dearborn: 64 = 88% Kansas City: 10 = 13% Unk. = 6
Build Dates: Did not break them down yet, however there is more than one truck from each month from 12/10 - 01/12.

It has warmed up to 75 to 80 degrees here in MN. Took my Ecoboost for a 6 hour trip the last 2 days. Ran like a top. No waste gate flapping and missing on hills at 55-60. I got 23.5 mpg at 70 mph on the interstate and then 22.5 on the lane state road at 55-60. More hills and small towns on that part of the trip. So my issue sure seems to be temperature related. I think that intercooler part/design could be the problem. I had bought my truck at the end of August 2011. It ran great until mid Oct when it started to get colder. Ran like crap all winter and now runs great again.
