Default Is riding in the bed legal?

So, I had a full truck the other day and someone said they wish we could just put people in the bed. In this particular case we were going on main roads, the highway and across the state border, but it got me wondering. I'm doing some research today this is what I've found so far. By the way I live in Massachusetts. From what I've collected it seems anyone over 12 can ride in the bed.

How would you guys interpret this?

very limited exceptions, and never at speeds more than five mph).

I'm not an expert but I believe that its illegal in some form in every state. Heck in Georgia you used to be able to have an open container in the cab of a truck as long as the driver wasn't drinking.

so, aside from it being dangerous, if there was seat belts seat belts for the passengers you could legally do it.

Not to derail the post but I don't see a problem with this or a problem with the driver drinking as long as they are under the legal limit. What is the difference in drinking at a bar/restaurant or drinking a beer while driving if you are under the legal limit? I know it would be harder to spot people drinking and driving, which is why its not legal I'm sure.

When I was deployed, guys would rent these old pickup truck that had a bench seat strapped/bolted down in the back.

If you click on map view from your link it gives a clearer interpretation, what I see are those 12 and older are NOT restricted from riding in the cargo area nor are 11 and younger if going less than 5mph and going less than 5 miles eg: parades, farming activity.

For Mass that is, each state is different.

Well, there are many ways to cull the gene pool. I wouldn't do it outside of on the beach (e.g., Daytona) or for short distances on off-road properties (e.g., farm), but then only at < 10 mph or so.
