Can a cop search your toolbox?
#11
Oh, as to the original question about the tool box, the answer is no. Unless it has a glass top, they can't see inside. They have no right to open it, your door, trunk, etc without A: your permission, or B: a warrant.
Period.
Period.

well as a cop.. depends on the state and the law... In N.Y WE THREW out the auto exception on a search. But if outside the vehicle and locked and I cant see in, I need reasonable suspision. I can ask you to open. Again at that point, here in n.y If you say no, I can detain you till I get to the judge for a warrant to open it. But Thats alot to get to. There are alot of different factors to get me, a cop to open a tool box.. every state/ city is different. But best advice is ,if you got nothing to hide, be as polite as can be, dont escalate it cause your gonna end up on the short end of the stick, just to prove a point. tHATS NOT SAYIN EITHER OF YOU ARE RIGHT.. Just let it go for another day

so you can stop us, for any reason, ask us to open our tool box, if we simply say "no" you can now DETAIN US, untill you get a warrant from a judge to search our tool box?! something is seriously wrong with that picture..
so while youre sitting around waiting for a warrent, and we are being "detained" , what happens when the judge denies the warrent? (does that ever even happen...) after all.. not wanting a cop to search all your personal property for no reason whatsoever must be some kind of sign of guilt, right?
once you deny them a search, every cop immediately assumes we are doing something wrong.. or have something to hide.. that mentality is insane. what happened to us just being able to tavel freely in this country without having to subject ourselves to ridiculous accusations because we dont want people goign through OUR STUFF?
why should we be polite to cops who are implying we are hiding something? they clearly arnt being polite to us... you have to earn respect, like everyone else, by being respectful to us,the badge doesnt mean you automatically get it..
"if you got nothin to hide" gotta love that statement, the old if you got nothing to hide then submit to my ridiculous request and do as i say or else youre hiding something!! its insane
like you said though, we WILL end up on the short end of the stick, because its an over policed nation we live in where you are guilty untill proven innocent, your posts , as a cop, makes that pretty obvious, cops have way too many rights, and its sickening, the law is always on your side, even when you screw up, cops never pay the price . you dont have to prove anything to DETAIN US, yuou can just DO IT because you feel like looking through our personal property.
"just let it go" - LOL !
so we should just curl up in a ball and submit to any ridiculous requests police officers make to us? thats insane! just because we didnt choose to carry a gun and a badge for a living.. doesnt mean we should just submit to every command you guys give us.. the attitude that we should respect you, no matter what, and submit to all your requests without standing up for ourselves is crazy talk.. its like we are sheep and you are the rancher.. we arnt here to serve you and listen to your requests, YOU WORK FOR US! remember that!
detaining us untill you get a warrant, ABSOLUTELY INSANE, 100% screams guilty untill proven innocent, we havnt done ANYTHING wrong except refuse your attempt at violating our rights.. and it gets us detained untill some judge somewhere decides to give you the go ahead to rip our personal property apart, most likely looking for MARIJUANA, give me a goddamn break, its sucha joke, the day they legalize pot is the day we get rid of half the free loading useless cops out there. thats why itll never happen.. half of the cops in this country couldnt justify their existence if it wasnt for $20 marijuana arrests on 18-30 year olds.
.. god bless america

Well my point is that we all have the right not to be searched if we do not want to. It is not an admission of guilt , simply telling the officer NO I do mind if you go through my things. The second part of all this is a little known ruling called the fruit of the poison tree. Any search deemed illegal that also gets more illegal activity is also inadmissable in court. So if you illegally are searched, they find a map to a bag of marijuanna buried in the yard, they cant use it either as evidence.
WE ALL NEED TO STOP BEING SHEEP !!! IT IS NOT ONLY PERMISSABLE TO QUESTION AUTHORITY ITS OUR DUTY TO QUESTION AUTHORITY... Without this right and responsibilty we are headed for a communistic society of tyranny and unjustice. These are the very principles that our founding fathers began a new nation a nation of the people by the people for the people... If you have nothing to fear and are doing nothing wrong then question authority and a few of the NEO **** police officers acting as if they are above the law, its time for them to meet the law.... Thanks for your time....

The last 2-3 decades have seen a rapid decline in the public opinion of your profession. Stuff like this is the reason why. I remember as a kid, everyone respected "Peace Officers" and would throw up their hand in greeting when Officer Friendly was spotted. Now, it's more likely 4 fingers less when you see one of today's breed of "LEO".

Alright fellas I apreciate all of the answers. That all helps me a lot. Be easy on the cop, he was just giving me an honest answer which is what I was asking for even if it is BS. Yes, there are a lot of corrupt cops these days which is unfortunate. And yes just because we dont agree to have them go through our personal belongings and disrespect our privacy does not make us guilty. To an extent questioning authority and trying to go against it is a good thing to do sometimes when you feel your rights are being violated. But to a further extent the majority of the time you will get the short end of stick. Yes I may still be a teenager and may not have as much first hand experience as some of you senior members, but I have had my fair share. Going against someone who has the power over you and your word is not the best idea. Yes, I have the urge many times a day to argue with people about things like this that I do not agree with whether it be the law or a teacher/administrator. If I am in a reasonable situation you sure as hell better know I'm going to tell you straight up how I feel to your face. But the majority of the time, you will get the short end of the stick when dealing with authority(yes I know from personal experience). Yes it is wrong but there is not too much we can do. Yes it is wrong to assume we are guilty. And yes it sucks we can't do too much about it. But this is the country we chose to live in and the laws we must abide by. Don't get me wrong one of my favorite songs is F the popo by Corey Smith. And yes I love the bumper sticker "Stop complaining, you voted for him. Not me."

Whats really lacking today more than anything is young people taking the time to actually find out what their rights are. Understand also under 18 you really only have the rights your parents give you. To many liberals want to tell us today how to raise our children. Here is a thought before you tell me how to do something maybe you should try it yourself. Its easy to be the quarterback from the cheap seats. Many have given there all for us to have the rights granted in the constitution. Knowing those rights is just respecting those that have given so much for us to have them at all.
If we give up freedom for security in the end we will have neither......

No, nothing to gain and much to lose if you let your temper rule your actions, but I WILL NOT give my permission. And if you get your panties in a wad about how you are the 'a-thor-ah-tee' and decide you wanna play your little game and "detain" me for no reason other than I exercised my 4th ammendment right? I guaranfarkingtee you'll wish you never laid eyes on me.
