Yes, the disclaimer is to use the parking brake - but, the truck still does not operate as it was intended to. It is easy to say use the parking brake to make sure it doesn't happen again. But the bottom line is the truck is not functioning as we purchased it - it is under warranty and they do not have an answer for it.

The dealership said they had never heard of such an issue - then I forwarded another complaint where the same model in the same state roled in a parking lot when the owner was in a movie theatre.

Frustrated with the lack of concern and more worried about the what if scenario if it happens again and causes a terrible injury to my family or another innocent bystander that should never have happened.

Trinity, Ford has a HUGE problem with their vehicles coming out of PARK. See for example, this website :
http://www.usautoinjurylaw.com/cases...-park-ford.htm

In a recent Georgia case, a jury spanked Ford with a $40 million dollar award to Jessica Munday, a 23 girl who was run over by her own Ford Explorer as it slipped out of park into powered reverse. The vehicle ran over her causing her to become paraplegic. During the trial, defense attorney presented evidence of 751 othe similar complaints. See http://www.morelaw.com/verdicts/case...=&s=GA&d=39937

The NHTSA is very close to announcing a recall for 2002-2005 Ford Explorers and Mercury Mountaineers:

http://www.newsinferno.com/defective...ssion-dangers/

I have had personal experience with this in my 2003 Ford F250 that slipped out of park into reverse, knocking me to the ground and nearly running over me. I was at a gas pump on level ground. I stepped out to check if the jetski I was towing was at the proper position for refueling. As I reached the rear bumper of the truck, the vehicle slipped out of park into powered reverse (engine was on). Thankfully the trailer jack-knifed and stopped what could have been a total disaster.

Say what you will about the parking brake, but the vehicle should not have come out of park and furthermore, the vehicle is equipped with a brake shift interlock (BSI), which also failed to operate as it should.

Some will argue that the vehicle must not have been in park. Well, if it's not in park, then it's in reverse, correct? You can not exit the vehicle if it is in reverse. Try it for yourself; the second your foot comes off the brake, the vehicle moves too rapidly in reverse for you to exit.

Secondly, the BSI should not have allowed the vehicle to move unless the driver's foot is on the brake.

Hundreds of accidents (several fatal) have been reported on this subject, yet the Ford dealership will claim "never heard of it" and "can't replicate customer complaint". Of course, like always, they refuse to admit to a problem and continue cranking out vehicles that have the same fatal flaw. The "park to reverse" defect affects millions of Fords on the road today. An admission by Ford could sink the company.

When I told the Dealership I bet they did not have all their new cars with emergency brakes set and that I would bet a majority of their employees did not have them set on the lot right now - their answer was I am sure you are 99% correct.
